CUSTODY TIME LIMITS

Delay in the criminal justice system is endemic. Custody time limits ( following the Scottish example) are intended to impose discipline and to improve expedition. However, rules can prove to be rigid, inflexibl e, complicated and productive of many applications to the Divisional C ourt; and potentially the public may be put at risk. Fudicial discreti on, to be exercised on well settled principles, may be preferable.
