Despite prohibitions by the ethical codes of all major mental health p
rofessions, therapist sexual misconduct remains a serious problem. Ove
r the past 13 years, individual states have enacted laws regarding the
rapist sexual misconduct with the hope of more successfully curbing th
is behavior. The laws fall into four categories: civil, criminal, repo
rting, and injunctive relief statutes. This article discusses the theo
retical underpinnings of the laws, examines the provisions of the exis
ting statutes, and provides an overview of the advantages and disadvan
tages of each category of statute. Preliminary evaluative data are als
o presented.
