This article seeks to evaluate the application in employment of recent
legislation on sexual harassment, by examining judicial and arbitral
decisions since 1990 in North America, and countries in Europe, the Fa
r East and Africa. After outlining national legislation and relevant i
nternational instruments, the author reviews key cases also brought un
der labour law, laws on non-discrimination, equality of opportunity, h
uman rights, health and safety, civil and criminal law. Trends emerge
in the perception of sexual harassment as employment discrimination; t
he importance of the legal framework used and the composition of the h
earing body; individual or employer liability; remedies and sanctions.
