This paper considers the legal criteria that will be applied to determ
ine whether a product is to be considered defective, together with the
consequences which may follow such a finding. The legal significance
of product certification is examined with a view to determining the im
pact which this may have upon the producer's legal liabilities. Examin
ation is also made of the legal position of a certification agency and
of the parties to whom a duty of care may be owed.
