The article proposes the adoption of an idea which has been notably ab
sent from debates in the criminal justice field in the United Kingdom,
despite its acceptance in other jurisdictions which employ jury trial
for serious criminal cases. This is jury waiver, nor in the sense tha
t the accused may opt for summary trial in place of jury trial, bur th
at the accused may instead choose to be tried in the Crown Court by a
judge sitting without a jury.
