Twenty years ago, in Volume 10 of the Harvard Journal on Legislation,
Jack Appleman analyzed the difficulties of using the regulatory powers
delegated by the Clean Air Act for reducing motor vehicle emissions.
This Article revisits the means by which Inspection and Maintenance pr
ograms currently instituted under the Clear Air Act work to improve ai
r quality and the problems that prevent I/M programs from realizing th
is goal. The authors discuss the impact of the 1992 Amendments to the
Clean Air Act on these problems, expressing concern regarding the amen
dments' limited effectiveness and the new problems that could arise du
ring implementation.
