Malignoma of the skin and their preliminary stages can be recognized a
nd compensated as occupational diseases in keeping with the social-leg
al premises according to the presently valid list of occupational dise
ases of the Federal Republic of Germany in cases of occupational expos
ure to arsenic, ionizing radiation as well as to soot, paraffin, tar,
anthrazene, pitch, or similar materials under figures 1108, 2402 and 5
102 of the German regulation for occupational diseases (BeKV Berufskra
nkheitenverordnung). At present, standardized recommendations of exper
ts for the assessment of the loss of earning capacity (MdE) with these
diseases are lacking. In considering the special individual criteria
of allocations in the statutory accident insurance, the histology of s
kin affections, their number localisation and extent as well as possib
ly increased sensitivity towards sunlight and cosmetic effects play, n
ext to primary and secondary functional losses, in our opinion a leadi
ng role in the assessment of loss of earning capacity due to occupatio
nally caused malignoma of the skin and their preliminary stages.
