The concern for violence against women has been a recent phenomenon. I
t is now recognised as a violation of women's human rights. The paper
examines the theoretical models explaining gender-based violence and d
emonstrates, through case illustrations, the factors that trap the vic
tim. In particular, it analyses the enactments of 498 A and 304 B, Ind
ian Penal Code, and their utility for Indian women subjected to violen
ce.
