Abstract
The article examines the Law Commission's proposal to retain the res g estae exceptions to hearsay in its Criminal Evidence Bill. It is argue d that the Bill's inclusionary discretion or ''safety valve'' renders the retention of the res gestae exceptions unnecessary and undesirable .
