There appears to be an increase in the number of representation electi
ons being held to determine whether employees desire to be represented
by a labor organization, as well as more union election victories. Th
is article presents practical and legal information on how to conduct
an effective representation campaign in order to remain union-free. Be
cause of the scope of the material covered, it is being presented in t
his and the next issue of Employee Relations Law Journal. This first p
art will present practical suggestions and the legal guidelines for re
maining union-free, as well as an overview of the organizing process a
nd election mechanics through start of the formal campaign period. In
the next issue, Part II will provide a legal overview of permissible a
nd impermissible employer conduct during a campaign, practical suggest
ions for running a successful campaign, and an overview of post-electi
on law and procedure.
