This article analyses two mutually-referred topics:the possibility,under Italian gambling law,to offer online-based gambling services.Further more,the paper deals with the relationship between the enforcement of the EU-Treatise-inspired right of establishment and the freedom of providing online betting services in country-namely Italy-where this activity is forbidden or,in certain cases,allowed only through State-approved private companies.Going through the comparison of some well-known juridical decision of both sides(the pro-EU and the cons-EU),the paper concludes that a)it is possible for a gambling provider legally established in an EU member country to extend its activity within the Italian jurisdiction and b)while the Italian gambling law could be interpreted in a way to allow the online gambling ,it would be necessary a clear amendment of the current laws.
