E. Friedheim, An Essenian conception of Halakha according to Josephus and the enigmatic silence of rabbinic literature regarding Talmudic law, STUD RELIG, 28(4), 1999, pp. 465-488
In this article, our purpose is to explain the absence of Josephus from the
Talmudic literature. In these texts there is no positive or negative, or j
ust informative mention about the Jewish historian. This enigmatic silence
raises many questions. Except the accusation of high treason against the Je
wish nation, it seems that other reasons evicted him from the collective me
mory of the Jewish people. To our mind, Josephus applies in some legislativ
e fields, an Essenian conception of the Halakha. It is then comprehensible
that in the days following the Great Revolt, when the Pharisees concentrate
the Halakha around a traditional pharisaic conception of the law, Josephus
does not find a place.
