The ongoing revolution in the realm of electronic media has extended t
o dispute resolution. ''Many court systems now allow out-of-town couns
el to appear at arguments on motion by telephone, and filings are rout
inely done by fax in some jurisdications,'' says author Daniel Yamshon
. This trend is reinforced by Yamshon's experience mediating a case in
which the parties were separated by 1,500 miles. The convenience prov
ided by such technological advances presents a unique set of challenge
s to the ADR professional. It requires special treatment of the disput
ants and could irrevocably alter the way neutrals evaluate evidence an
d testimony.
