Abstract
The modern system of alternative dispute resolution has a number of it s roots in Native American culture. Tribal justice focused on healing elements-clan relations, harmony, leadership by reputation and respect , ''and a focus on making victims whole.'' The dispute resolution meth od of choice was mediation, primarily because of the demands imposed b y an environment that required the combined efforts of the community t o succeed. Disputes were discussed among those involved until everyone agreed on a course of action.
