Every one is liable for all injuries caused to a human being. As the penal
responsibility has never been involved until now in cases of HVC contaminat
ion, claims for compensation are very frequent in return. Before recalling
those who could be sue for damages - accident's perpetrators, blood or care
institutions - the authors relate 3 principles for the expert appraisal: p
roove the reality of the infection, the veracity of the blood transfusions,
establish a link of causality between transfusions and HCV contamination.
Finally, the different compensations are cited in the perspective of compen
sating the medical accidents in the future. (C) 1999 Elsevier; Paris.
