No topic in land use regulation has been more important in recent years tha
n the issue of takings: how far can land use regulation go before courts wi
ll find it illegal or require government to pay compensation to land owners
whose property has been "taken" as a result Of overregulation (unlike an a
ctual taking of property through the exercise of the power of eminent domai
n). This article examines the substantial recent literature of takings, emp
hasizing the role played by the United States Supreme Court, which has deve
loped a fairly complex view on takings. In addition to Supreme Court matter
s, the bibliography also reviews state takings issues, questions of policy;
and legislative action.
