Abstract
We argue that the House of Lords' decision on the law of provocation in the recent case of Smith was mistaken in at least nine respects. In its excusa tory doctrines, the criminal law admittedly needs to forge an intelligent r esponse to human diversity in general and social pluralism in particular. B ut this decision is not it.
