This article examines current policy concerning the interstate transpo
rt of waste with particular reference to the relative role of differen
t levels of government in shaping and implementing waste management po
licy in five key United States Supreme Court cases and two recent Cour
t of Appeals cases. The intergovernmental tensions between the federal
courts and state and local governments are highlighted, the clashes b
etween law and policy are discussed and the implications for public ma
nagement are analyzed.
